The new rule mandates that each H-1B petition be accompanied by a <strong data-start=\"423\" data-end=\"443\">$100,000 payment<\/strong>, a change set to reshape how American companies hire foreign talent, particularly from India. The <a href=\"https:\/\/newsraise.com\/index.php\/2025\/09\/20\/h-1b-visa-shock-trumps-100000-fee-hits-indian-it-workers-hard\/\">President<\/a> defended the overhaul by arguing that the H-1B visa system has been misused over the years.<\/p>\n<p data-start=\"994\" data-end=\"1215\">He singled out information technology (IT) companies for taking advantage of the visa framework, saying their reliance on cheaper foreign labor has \u201csignificantly harmed American workers in computer-related fields.\u201d<\/p>\n<h3 data-start=\"1217\" data-end=\"1255\"><strong>Effective Date and Applicability<\/strong><\/h3>\n<p data-start=\"1257\" data-end=\"1431\">The new order comes into effect at 12:01 am from September 21, 2025, and applies only to foreign nationals entering or attempting to enter the US after that date.\u00a0However, the restrictions are not permanent by default. The proclamation notes that the rule will automatically expire one year later, unless formally extended.<\/p>\n<p data-start=\"1631\" data-end=\"1830\">While the order sets strict payment requirements, it also allows flexibility under certain conditions. The Secretary of Homeland Security has the authority to waive the payment requirement for:<\/p>\n<ul>\n<li data-start=\"1834\" data-end=\"1862\"><a href=\"https:\/\/newsraise.com\/index.php\/2025\/09\/20\/h-1b-visa-shock-trumps-100000-fee-hits-indian-it-workers-hard\/\">Individual H-1B applicants<\/a><\/li>\n<li data-start=\"1865\" data-end=\"1900\">All employees of a single company<\/li>\n<li data-start=\"1903\" data-end=\"1945\">Entire industries employing H-1B workers<\/li>\n<\/ul>\n<h3 data-start=\"2102\" data-end=\"2134\"><strong>Compliance and Enforcement<\/strong><\/h3>\n<p data-start=\"2136\" data-end=\"2425\">The order directs employers to maintain proof of payment for each H-1B petition. The Secretary of State will verify payment receipts, while the Department of Homeland Security (DHS) and the Department of State (DOS) will deny entry to workers whose employers fail to pay.\u00a0Additionally, Trump ordered the Secretary of Labor to launch a rulemaking process to revise prevailing wage levels for H-1B workers, aligning salaries with the goals of the new policy.<\/p>\n<p data-start=\"2136\" data-end=\"2425\">DHS has also been tasked with developing a system to prioritize high-skilled and high-paid applicants in future H-1B admissions.\u00a0A follow-up interagency report is due within 30 days of the next H-1B lottery. The Secretaries of State, Labor, and Homeland Security, along with the Attorney General, will recommend whether the fee requirement should be extended beyond the initial one-year period.<\/p>\n<p data-start=\"3074\" data-end=\"3467\">The order has already prompted urgent guidance from US corporations. Microsoft advised its <a href=\"https:\/\/newsraise.com\/index.php\/2025\/09\/20\/h-1b-visa-shock-trumps-100000-fee-hits-indian-it-workers-hard\/\">H-1B and H-4 visa holders<\/a> currently in the US to remain in the country and urged those abroad to return before September 20 to avoid complications. Similarly, JPMorgan\u2019s immigration counsel has recommended that employees on H-1B visas avoid international travel until further notice.<\/p>\n<p data-start=\"3074\" data-end=\"3467\"><strong>Challenge Ahead for Indians<\/strong><\/p>\n<p data-start=\"3469\" data-end=\"3875\">Industry analysts warn that the order will make it harder for US tech firms to hire global talent, particularly early-career professionals from countries like India, which accounts for the majority (almost 70%) of H-1B visa approvals annually. Employers may become reluctant to sponsor foreign workers due to the steep new costs, reducing job mobility and potentially creating workforce shortages in critical tech sectors.<\/p>\n<p data-start=\"3916\" data-end=\"4189\">The $100,000 H-1B fee marks one of the most significant changes to the program since its inception in 1990.
