Speaking after the Cabinet meeting, CM Sarma announced that the proposed legislation will introduce a <strong data-start=\"731\" data-end=\"779\">maximum penalty of seven years\u2019 imprisonment<\/strong> for individuals found guilty of engaging in multiple marriages while their first spouse is still alive.<\/p>\n<p data-start=\"229\" data-end=\"627\">He emphasized that the offence would be <strong data-start=\"924\" data-end=\"955\">cognizable and non-bailable<\/strong>, underscoring the government\u2019s strong stance against the practice. \u201c<em>After the passing of this Bill, anyone marrying for the second or third time will face imprisonment for seven years. The offence will be cognizable, which means bail will not be granted immediately<\/em>,\u201d said Sarma.<\/p>\n<h4 data-start=\"1240\" data-end=\"1290\"><strong data-start=\"1245\" data-end=\"1290\">Compensation Fund for Victims of Polygamy<\/strong><\/h4>\n<p data-start=\"1292\" data-end=\"1699\">The Chief Minister also revealed that the Bill includes a <strong data-start=\"1350\" data-end=\"1416\">special provision to support women who are victims of polygamy<\/strong>. Under this clause, the <a href=\"https:\/\/newsraise.com\/in\/2025\/10\/27\/ecis-special-intensive-revision-list-to-roll-out-phase-1-ready\/\">Assam government will create<\/a> a <em>compensation fund<\/em> to provide financial assistance to affected women\u2014whether they are the first wives abandoned by their husbands or second wives who entered the marriage without knowledge of the man\u2019s existing relationship.<\/p>\n<p data-start=\"1701\" data-end=\"2097\">\u201cAfter the man is imprisoned, what happens to the woman? Often, the second wife is unaware of the man\u2019s first marriage, or the first wife is abandoned after he marries again. To ensure that no woman becomes a victim, a compensation fund will be established,\u201d Sarma explained, adding that the quantum of compensation and eligibility criteria will be decided once the detailed rules are framed.<\/p>\n<h4 data-start=\"2099\" data-end=\"2133\"><strong data-start=\"2104\" data-end=\"2133\">Exemptions Under the Bill<\/strong><\/h4>\n<ul>\n<li data-start=\"2135\" data-end=\"2593\">While the legislation aims to apply to the general population, Sarma clarified that it will not extend to Scheduled Tribe communities and tribal districts governed under the Sixth Schedule of the Constitution.<\/li>\n<li data-start=\"2135\" data-end=\"2593\">This includes regions such as Bodoland Territorial Council (BTC), Dima Hasao, and Karbi Anglong.<\/li>\n<li data-start=\"2135\" data-end=\"2593\">Additionally, minority Muslims residing in Sixth Schedule areas prior to 2005 will also be exempted from the Bill\u2019s provisions.<\/li>\n<\/ul>\n<h4 data-start=\"2595\" data-end=\"2638\"><strong data-start=\"2600\" data-end=\"2638\">Background and Legislative Context<\/strong><\/h4>\n<p data-start=\"2640\" data-end=\"3119\">The proposal follows Assam\u2019s earlier announcement in 2023 to draft an anti-polygamy law. A committee headed by retired Guwahati High Court judge Justice Rumi Phukan was constituted to assess the <a href=\"https:\/\/newsraise.com\/in\/2025\/09\/25\/ladakh-protests-explained-bjp-accuses-congress-of-foul-play\/\">state\u2019s legislative competence<\/a> in enacting such a law.
