The petition, filed by L Ramanathan, sought a declaration that police investigations are sovereign and independent, and that the earlier quashing of the FIRs should be reviewed.

Background to the petition

The FIRs in question stemmed from the July 20 “Sansad Chalo” demonstration, organized by the Cockroach Janta Party to protest alleged NEET paper leaks and broader irregularities in the education system. Following the protest, Delhi Police registered multiple FIRs against participating students and others, alleging violence and other offences.

After widespread public outcry, the Supreme Court on August 3 clarified that authorities could close or withdraw the FIRs against the students. That clarification was part of a negotiated settlement in which the Union agreed to withdraw the FIRs as a pre‑condition for ending the nationwide protests.

Subsequently, on September 1, the Court exercised its powers under Article 142 of the Constitution to quash the FIRs outright, taking into account the age of the protesters and the potential impact on their families and futures.

Petitioner’s arguments and court’s response

Mr. Ramanathan’s petition, filed before the September 1 order, argued that the judiciary should not interfere with police functions, describing the police as “independent and sovereign”. He contended that any interference should be limited to instances where the police act contrary to law, a factual question that he claimed required investigation.

Advocate Mathews J Nedumpara, representing the petitioner, questioned the maintainability of a PIL that lacked a direct litigant, remarking that people were treating the Court “as though it were their private property”.

Chief Justice of India Surya Kant, hearing the petition alongside Justices Joymalya Bagchi and V Mohana, explained that the Court’s earlier use of Article 142 was motivated by humanitarian considerations. “You say we should not have invoked Article 142 and quashed FIRs. Please appreciate, these are young students. We have to see their parents, their future. We don’t want them to come to court,” the CJI said.

The bench also referenced a recent Supreme Court order that quashed criminal cases in Himachal Pradesh related to public protests during the Covid‑19 pandemic. The Chief Justice observed, “In Himachal Pradesh, they sat on dharna, they caused loss to public property. But when there was COVID, people of this country were not ready to face this kind of crisis, so people reacted in a way they could react.” The reference underscored the Court’s willingness to temper legal action when broader societal circumstances are at play.

While the Delhi High Court had declined to quash the FIRs, the Supreme Court intervened, emphasizing that the protesters were students, not hardened criminals. The bench concluded that the relief sought in the petition amounted to a direct challenge to its own earlier decision.

Chief Justice Kant told Advocate Nedumpara, “Your client should see our order. This petition is like seeking review of our order (quashing FIRs by invoking Art. 142).” Accordingly, the petition was dismissed.

Implications of the dismissal

The dismissal reaffirms the Supreme Court’s stance that its earlier exercise of constitutional powers to quash the FIRs remains final. By rejecting the request for an independent investigation, the Court signals that it does not view the police’s handling of the Jantar Mantar FIRs as unlawful, provided the cases remain withdrawn as per the August 3 clarification.

Legal analysts note that the decision underscores the Court’s willingness to intervene in matters where the consequences for young protesters could be disproportionate. It also illustrates the limited scope of PILs that lack a direct aggrieved party, especially when they seek to overturn a higher court’s own judgment.

The case, cited as L Ramanthan v Union of India | WP(c) 1020/2026, will likely be referenced in future debates over the balance between police autonomy and judicial oversight, particularly in the context of mass protests and public order.

The Supreme Court rejected a petition seeking a fresh investigation into FIRs filed against students who protested at Jantar Mantar, reaffirming its earlier order that quashed the cases.

[299
2772,2648,2063,2726,2771,335
post-2534","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-news","tag-article-142","tag-delhi-police","tag-fir","tag-jantar-mantar","tag-student-protests","tag-supreme-court","entry
["GET
