In the latest development concerning the waiting period and unprecedented rush pertaining to the US Visa<\/a> for H-1B applicants, the USCIS (United States Citizenship & Immigration Services)<\/a> has released the latest directive, stating it would continue to accept and process petitions that are otherwise exempt from the cap. The US Citizenship and Immigration Services has received enough petitions to reach the mandated 65,000 H-1B visa regular cap and the 20,000 H-1B visa advanced master\u2019s cap, for the fiscal year 2026.<\/p>\n

With six months to go for the current calendar year to end, the applications reaching the threshold limit this early itself justifies the preference and craze the H-1B visa type enjoys. An H-1B allows employers to hire foreign workers who have specialized skills and a bachelor’s degree or equivalent.<\/p>\n

Interestingly, Indians have consistently dominated H-1B visa issuances. According to the USCIS, the H-1B classification has an annual numerical limit (cap) of 65,000 for new statuses\/visas each fiscal year. An additional 20,000 petitions filed on behalf of beneficiaries who have earned a master\u2019s degree or higher from a US institution of higher education are exempt from the cap limit.<\/p>\n

In its latest statement, USCIS said that it would continue to accept and process petitions that are otherwise exempt from the cap.<\/p>\n

\u201cPetitions filed for current H-1B workers who have been counted previously against the cap, and who still retain their cap number, are exempt from the FY 2026 H-1B cap<\/em>,\u201d it said.<\/p>\n

We will continue to accept and process petitions filed to:<\/p>\n

    \n
  1. Extend the amount of time a current H-1B worker may remain in the United States<\/li>\n
  2. Change the terms of employment for current H-1B workers<\/li>\n
  3. Allow current H-1B workers to change employers<\/li>\n
  4. Allow current H-1B workers to work concurrently in additional H-1B positions.<\/li>\n<\/ol>\n

    According to the data from the US Citizenship and Immigration Services (USCIS), it has received around over 3 lakh forty thousand eligible H-1B cap registrations for the 2026 fiscal year, of which, around 7800 were beneficiaries with multiple eligible registrations. However, the agency had actually selected around one lakh twenty thousand applications that seemed to be valid.<\/p>\n

    According to the USCIS, the number of eligible registrations fell by almost 27% for FY 2026 in comparison with FY 2025. The reasons for this decline could be attributed to the rising internal tensions within United States, political instability and economic situation<\/a> with reference to trade, jobs, skilled employee requirement, and the stringency with matters pertaining to visa checks.
