How to cancel/submit your GST number?

 

In this article, know how to complete the process of canceling the GST (Goods and Services Tax) number within a month. In a webinar held by the Institute of Chartered Accountants of India (ICAI) of Ranchi Branch, CA Navya Malhotra, New Delhi’s indirect expert said that in the event of a single businessman passing away, the related member must cancel the registration of their GST number within a period of 1 month as GST number is based on PAN number and PAN number will be different for every person.

If in case the business wants to be continued by his friend or a relative or any other person, then it is a must and should for them to cancel the old GST number and get the new GST number. And if in case the business is not to be continued by anyone, then the process of cancellation of registration is to be followed by anyone related to the person who died. Cancellation of GST registration simply means that the taxpayer will not be a GST registered person anymore. He will not have to pay or collect GST or claim the input tax credit and accordingly, need not file GST returns.

In a few cases, registration under GST is mandatory under law. If in any case, GST registration has been canceled but if the business is still being continued, then it will be considered an offense under Goods and Service Tax law and there are high chances of heavy penalties to be imposed on the business being carried on. 

What is the recent update on Goods and Service Tax return filing?

Due to the present pandemic situation and ongoing lockdowns, the government has taken major steps and decisions in favor of the citizens, businesses, and many other people of the nation. One such decision taken by the Union government is that it has given an extended date for filing returns for 2 months of March and April but on the condition that it will be waiving only late fees but the interest will be charged as usual. Those businesses with a turnover of more than 50 million (5 crores) are compulsorily required to write HSN code from the new accounting year, 1st April 2021.

Many experienced Chartered Accountants stated in the webinar saying that the government has given permission for conducting board meetings through video conferences and also stated that a lot of changes have been implemented in the Companies Act wherein new columns have been added to the format of Financial Report of the Act making the work of Chartered Accountant’s more tedious and time-consuming while preparing the current year’s financial report and the companies are to specify details even regarding a promoter’s share. And it is important for everyone to stay updated about the recent developments and changes made in commercial laws. 

Here are the steps on how to cancel your GST registration online:

  1. Go to the GST (Goods and Services Tax) website and log in to your GST portal. Click on the ‘Cancellation of Provisional Registration’.
  2. After the cancellation page opens, enter your GSTIN and the name of your business will pop up automatically. 
  3. Specify the reason for the cancellation of GST registration. 
  4. Then lastly it will ask whether you are issued with tax invoices during a month and also you will have to fill in certain details like place, authorized signatures, etc… If you are not issued then this process will be easier but if you are issued with an invoice, then FORM GST REG- 16 needs to be filled by you which has a different procedure.
